Unless otherwise agreed to in writing and signed by both parties, any additional, different, or inconsistent terms, conditions, or limitations contained in any purchase order, form, or other document submitted by Buyer are hereby rejected and shall not apply.

Mulch Direct rubber mulch is guaranteed to be 99.9% free of steel by weight.

Mulch Direct shall not be liable for any loss, damage, injury, or claim resulting from defects in the goods sold or from the use, installation, or application of the products. Buyer agrees to indemnify, defend, and hold harmless Mulch Direct from and against any and all claims, liabilities, damages, losses, costs, and expenses arising out of or related to the purchase, sale, use, handling, or consumption of the goods by Buyer or any subsequent user.

Buyer further agrees to pay any judgments rendered against Mulch Direct arising from such claims and to reimburse Mulch Direct for all costs and expenses incurred in defending such actions, including reasonable attorney fees, expert witness fees, and court costs.

These terms and conditions shall be governed by and construed in accordance with the laws of the State of New Jersey.

All overdue balances shall accrue interest at a rate of 3% per month. Buyer shall also be responsible for all costs associated with the collection of outstanding debts, including attorney fees and court costs.

Prices do not include installation.

Buyer is responsible for reviewing and complying with all applicable local, state, and federal laws, regulations, guidelines, and safety recommendations regarding the use of playground and safety surfacing materials.
